These Terms of Service ("Terms") govern your access to and use of the websites, mobile applications, AI storytelling features, public sharing features, and any related services operated by ELEN Story AI ("we," "us," "our," or "ELEN Story AI") (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you use the Service on behalf of another person, family, school, employer, or organisation, you represent that you have authority to bind that person or organisation to these Terms. If you do not agree to these Terms, do not access or use the Service. These Terms constitute a legally binding agreement between you and ELEN Story AI.
You must be at least 18 years of age, or the age of majority in your jurisdiction, to create an ELEN Story AI account. Children may use child-facing features only under the supervision of a parent, guardian, teacher, or other authorised adult. By creating or managing a child profile, you represent that you are authorised to provide the information entered and that you have obtained all consents, notices, or permissions required by applicable law or school policy — including, where applicable, verifiable parental consent under the U.S. Children's Online Privacy Protection Act ("COPPA"), the EU General Data Protection Regulation ("GDPR"), or similar laws in your jurisdiction. Misrepresenting your age or authority is a breach of these Terms.
You must provide accurate, current, and complete information when creating your account and must keep your account information up to date. You are solely responsible for maintaining the confidentiality of your credentials, controlling access to your devices, and safeguarding any parental PINs or similar controls. You are generally responsible for all activity that occurs under your account, except to the extent caused by our breach of these Terms or applicable law. If we reasonably suspect fraud, abuse, unauthorised access, or other security concerns, we may require verification, restrict access, or suspend activity without prior notice.
ELEN Story AI provides AI-powered tools for generating stories, illustrations, narrations, videos, and similar creative materials for educational and family entertainment purposes. The Service may change over time; features may be added, removed, restricted, or discontinued. AI outputs are probabilistic in nature and may be inaccurate, incomplete, biased, inappropriate, or unexpectedly formatted. Content safety filters reduce risks but are not infallible. You must review prompts and outputs before relying on them, sharing them publicly, or showing them to a child. The Service is intended for creative and educational purposes only and does not constitute — and must not be relied upon as — medical, psychological, legal, emergency, developmental, or professional advice of any kind.
As between you and ELEN Story AI, you retain ownership of prompts and other content you submit, to the extent you own such rights. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, modify, and display your content to the extent reasonably necessary to operate, protect, improve, and support the Service. When you make a story public, you authorise us to display and distribute that content in accordance with your sharing settings; once published, others may view, copy, share, or cache it. Subject to these Terms, we grant you a limited, revocable, non-transferable licence to use the Service and your outputs for personal, family, classroom, or internal educational purposes. Without our prior written permission, you may not resell the Service or exploit AI-generated outputs at commercial scale for distribution to third parties.
The Service, including its software, visual design, brand features, and non-user content, is owned by ELEN Story AI or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reverse-engineer, scrape, frame, reproduce, republish, or create derivative services from the Service except as expressly permitted by law or by our prior written consent. You must also respect the rights of others and must not use the Service in a manner that infringes another party's copyright, trademark, privacy, publicity, or other rights.
You agree not to use the Service to: generate content that is violent, sexually explicit, hateful, discriminatory, or harmful to minors; attempt to circumvent or manipulate content safety filters; expose sensitive information without authorisation; harass, abuse, or harm others; impersonate any person or organisation; infringe the rights of third parties; transmit viruses, malware, or harmful code; disrupt the Service, its servers, or networks; use automated means (bots, scrapers, crawlers) without our written permission; reverse-engineer, benchmark, or use the Service to build a competing product; violate applicable law or these Terms; or attempt unauthorised access to other users' accounts or data. Violations may result in immediate suspension or termination of your account, with or without prior notice, and we reserve all legal remedies.
The Service may offer free tiers, paid subscriptions, one-time credit purchases, and other paid features. Prices, limits, and plan details are displayed at checkout or within the product and are subject to change with reasonable notice. Web subscriptions are generally processed by Polar; in-app purchases may be processed by Apple, Google, or another app store provider, and you also agree to that provider's terms. Unless otherwise stated at checkout or required by applicable law: subscriptions may auto-renew until cancelled; credits are non-transferable, non-refundable, and have no monetary value; applicable taxes or platform fees may apply; and we may change prices prospectively with required advance notice. If you believe you have been incorrectly charged, contact us promptly. Nothing in these Terms limits any mandatory statutory right to a refund or remedy you may have.
Your use of the Service is also governed by our Privacy Policy and Children's Privacy Notice. Those documents explain how we handle account data, prompts, public stories, and information related to child profiles. By using the Service, you consent to our data practices described therein.

The Service does not collect personal information from children — child profiles are anonymous (magical name + avatar + reading-level band) and children cannot generate stories or type free-text prompts. ELEN Story AI is not liable for content generated in response to prompts you provide, including any content that safety filters fail to intercept. You remain solely responsible for reviewing AI outputs before showing them to a child.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM HARMFUL COMPONENTS, NOR THAT AI OUTPUTS WILL BE ACCURATE, SAFE, ORIGINAL, OR SUITABLE FOR ANY PARTICULAR CHILD OR PURPOSE. TO THE FULLEST EXTENT PERMITTED BY LAW, ELEN STORY AI AND ITS OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED US DOLLARS (USD 100). To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless ELEN Story AI and its officers, directors, employees, agents, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your access to or use of the Service; (b) your breach of these Terms; (c) your violation of any third-party right, including intellectual property, privacy, or publicity rights; (d) any content you submit, generate, or publish through the Service; or (e) your misrepresentation regarding your age, authority, or consent obligations with respect to any child profile.
You may stop using the Service at any time and request deletion of your account through available product settings. We may restrict, suspend, or terminate your access immediately, with or without notice, if we reasonably believe you have violated these Terms, created a significant legal or security risk, misused child-related features, failed to pay amounts owed, or if suspension is required by law or platform policy. Upon termination for any reason, all licences granted to you under these Terms terminate immediately. Provisions that by their nature should survive termination will survive, including those relating to intellectual property, payments, disclaimers, limitation of liability, indemnification, and dispute resolution.
We may revise these Terms from time to time. For material changes, we will update the version date, publish the revised Terms, and may display an in-product notice or require your agreement to the updated Terms before you continue using certain features. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms, to the extent permitted by law.
To the fullest extent permitted by applicable law, these Terms are governed by the laws of the jurisdiction in which ELEN Story AI is established, excluding conflict-of-law principles. Before initiating formal legal proceedings, you and ELEN Story AI agree to attempt in good faith to resolve any dispute informally by contacting [email protected]. If informal resolution fails within 30 days, disputes may be brought before a court of competent jurisdiction. If mandatory consumer-protection law in your country of residence grants you rights or limits the applicable choice of law, those rights are not affected by this clause.
These Terms, together with the Privacy Policy and Children's Privacy Notice, constitute the entire agreement between you and ELEN Story AI regarding the Service and supersede all prior agreements. If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force. Our failure to enforce any provision is not a waiver of our right to do so in the future. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
